1. Acceptance of Terms

By accessing and using the Pureez platform ("Platform"), whether through our website, mobile application, or any associated services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must discontinue use of the Platform immediately.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Pureez ("we," "us," "our," or "Company"), a Kenyan-registered business operating an online marketplace for pre-owned and new household goods, vehicles, and properties.

2. Eligibility

You must be at least 18 years of age or the age of legal majority in your jurisdiction to use this Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

If you are accessing the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To access certain features of the Platform, you may be required to create an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain the security and confidentiality of your login credentials.
Accept responsibility for all activities that occur under your account.
Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Marketplace Rules

4.1 Buyers

As a buyer, you agree to:

Review product descriptions, images, and condition details carefully before purchasing.
Communicate respectfully with sellers and platform representatives.
Complete transactions in good faith once an order is confirmed via WhatsApp.
Not engage in fraudulent chargebacks or dispute manipulation.

4.2 Sellers

As a seller on Pureez, you agree to:

Provide accurate and truthful descriptions of the items you list, including condition, defects, and pricing.
Not list items that are counterfeit, stolen, illegal, or hazardous.
Respond to buyer inquiries promptly and in good faith.
Ship or deliver items within the agreed-upon timeframe after payment confirmation.
Comply with all applicable Kenyan laws and regulations regarding the sale of goods.

4.3 Prohibited Listings and Conduct

You may not list, request, or transact in prohibited items or use the Platform in a way that harms Pureez, other users, or the public. Prohibited conduct includes:

Misrepresenting item condition, ownership, delivery status, or identity.
Listing stolen, counterfeit, replica, recalled, illegal, or unsafe items.
Listing weapons, firearms, ammunition, drugs, alcohol, tobacco products, adult content, hazardous materials, or personal information.
Making false non-delivery claims, abusing refunds, or manipulating disputes.
Introducing malware, spam, scraping tools, or attempting to interfere with Platform infrastructure.
Circumventing Pureez review, support, or fee processes where they apply.

5. Pricing & Payments

All prices displayed on the Platform are in Kenyan Shillings (KES) unless otherwise stated. Pureez does not currently process payments directly through the Platform. All transactions are facilitated via WhatsApp communication with our authorized sales agents.

Any applicable platform fee, seller commission, delivery fee, or service charge will be communicated during the relevant seller onboarding, listing review, or WhatsApp-assisted checkout process before confirmation.

Pureez reserves the right to adjust pricing, offer discounts, or modify any promotional offers at any time without prior notice.

6. Delivery & Shipping

Delivery timelines vary based on location and product availability. Pureez partners with third-party logistics providers and is not liable for delays caused by circumstances beyond our control, including but not limited to weather conditions, customs delays, or carrier issues.

Delivery fees, if applicable, will be communicated to you during the WhatsApp checkout process before order confirmation.

7. Returns & Refunds

Given the nature of secondhand goods, returns and refunds are handled on a case-by-case basis. You may request a return within 48 hours of receiving an item if:

The item received is significantly different from its description.
The item is damaged in transit (with photographic evidence).
The wrong item was delivered.

Contact our support team via WhatsApp to initiate a return. Items must be returned in the same condition in which they were received.

8. Fraud Prevention and Verification

To protect buyers, sellers, and the Platform, Pureez may review listings, monitor suspicious transaction patterns, request additional information, or require identity or ownership verification for selected sellers, high-value items, or unusual activity.

Users must cooperate with reasonable verification and dispute-review requests. Pureez may suspend listings, delay publication, refuse a transaction, or restrict an account where fraud, misrepresentation, illegal activity, or safety risk is suspected.

9. Intellectual Property

All content on the Pureez Platform — including but not limited to text, graphics, logos, images, software, audio, video, and the arrangement thereof — is the property of Pureez or its licensors and is protected by Kenyan and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or publicly display any Platform content without our prior written consent.

10. Prohibited Activities

You agree not to:

Use the Platform for any unlawful purpose or in violation of any applicable laws.
Upload or transmit viruses, malware, or any harmful code.
Scrape, crawl, or use automated tools to extract data from the Platform without authorization.
Impersonate any person or entity, or misrepresent your affiliation.
Interfere with or disrupt the Platform's infrastructure or other users' access.
Post false, misleading, defamatory, or offensive content.

11. Limitation of Liability

To the maximum extent permitted by Kenyan law:

Pureez provides the Platform on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
Our total aggregate liability to you for any claim arising from or related to these Terms shall not exceed the amount you paid to Pureez in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Pureez, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of your use of the Platform, violation of these Terms, or infringement of any third party's rights.

13. Dispute Resolution

Any dispute arising from or related to these Terms shall be resolved as follows:

Informal Resolution: The parties shall first attempt to resolve the dispute informally through good-faith negotiation.
Mediation: If informal resolution fails, the parties agree to submit the dispute to mediation in accordance with the Nairobi Centre for International Arbitration (NCIA) mediation rules.
Arbitration: If mediation is unsuccessful, the dispute shall be referred to binding arbitration under the Arbitration Act (Cap. 49, Laws of Kenya).

These Terms shall be governed by and construed in accordance with the Laws of Kenya.

14. Modifications

Pureez reserves the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms on the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
